Plants for Health

1. Definitions
The following definitions apply to these Terms and Conditions:
- Client: the individual who purchases the Plants for Health book exclusively for personal use.
- Participant: the individual who enrolls in a Plants for Health lifestyle program for personal use.
- Plants for Health Lifestyle Program: the lifestyle program including all associated components such as the learning management system (LMS), e-book, group sessions, forum, (optional) individual coaching, and (optional) the Plants for Health Lifestyle Club.
- Plants for Health Lifestyle Club: a continuous subscription to Plants for Health services, available to participants who have completed the 12-month Plants for Health Lifestyle Program.
- Cooking Workshop: a live (in-person at a location to be determined) or online cooking workshop.
- Plants for Health Coach: a specialized and accredited healthcare professional (such as a registered dietitian or physiotherapist) authorized to deliver the lifestyle program, conduct individual consultations, and lead group sessions.
- Individual Consultations: one-on-one sessions between participants and Plants for Health Coaches, in-person or online.
- Group Sessions: sessions with multiple participants and one or more Plants for Health Coaches.
- Book: the Plants for Health book.
- LMS: the learning management system (e-learning platform) of Plants for Health.
- Forum: the online forum integrated into the LMS, accessible to participants and Plants for Health Coaches.
- Meet-ups: online (live) sessions open to (larger groups of) participants.
These Terms and Conditions apply to both the purchase of the Plants for Health book and enrollment in the Plants for Health Lifestyle Program or Lifestyle Club. Where specific conditions apply to only one product or service, this is expressly stated. Articles 2, 4, and 5 do not apply to the standalone purchase of the book.
2. Duration and Termination of the Agreement
The duration of the lifestyle program is stated per program on the website. Participation commences upon receipt of full payment, or upon receipt of the first installment if a payment plan has been selected.
The Plants for Health Lifestyle Club is a continuous agreement with an annual membership fee, payable in advance. The participant may cancel the Lifestyle Club at any time, subject to one month’s written notice. Cancellation must be submitted in writing by email to [email protected]. Upon cancellation, any amount paid in advance for remaining full months of the current membership year will be refunded on a pro-rata basis within 14 days of the membership end date.
Plants for Health reserves the right to suspend a participant’s access to the program and associated services (LMS, forum, group sessions) in the event of non-payment. The participant will be notified in writing.
3. Pricing and Payment Terms
All prices are in euros and inclusive of VAT (where applicable), unless expressly stated otherwise. For participants located outside the European Union, VAT treatment is determined by applicable local regulations; Plants for Health will apply the correct rate accordingly.
For installment payments and the Plants for Health Lifestyle Club, Plants for Health uses direct debit within the SEPA zone. The participant grants written SEPA authorization for this purpose. Plants for Health will notify the participant of the amount to be debited at least 1 calendar day before the debit date (pre-notification). For participants outside the SEPA zone, an alternative payment method will be agreed upon.
In the event of a chargeback, late payment, or payment arrears, Plants for Health is entitled to:
- charge an administration fee of up to €15.00 per reminder;
- suspend participation until all payment obligations have been fulfilled;
- transfer the outstanding amount to a debt collection agency. Statutory collection costs will be charged to the participant in accordance with applicable law
4. Services and Responsibilities
Plants for Health provides services as described on the website.
In the event of illness or absence of a Plants for Health Coach, Plants for Health will arrange a suitable replacement or, where this is not possible, will reschedule the appointment or session.
Plants for Health reserves the right to refuse or exclude participants, for example on medical or other legitimate grounds. The participant will be informed in writing. Amounts already paid for services not yet rendered will be refunded on a pro-rata basis within 30 days, unless the refusal or exclusion results from the participant’s breach of these Terms and Conditions.
5. Changes and Cancellations
Cancellation or rescheduling by the participant:
- Individual consultations: may be rescheduled free of charge up to 48 hours before the scheduled appointment. Cancellations or changes within 48 hours will be charged in full.
- In-person group sessions and cooking workshops: may be cancelled free of charge up to 1 month before the session date. Cancellations within 1 month are non-refundable.
Cancellation or changes by Plants for Health:
If Plants for Health cancels or reschedules a session or consultation, the participant will be informed as soon as possible, and an alternative will be offered. If no suitable alternative can be provided, any amounts already paid for the relevant service will be refunded within 14 days.
6. Privacy and Confidentiality
Plants for Health handles participants’ personal data with care and maintains strict confidentiality. Information shared by participants during the program will not be disclosed to third parties without explicit consent, unless required by law.
Plants for Health complies with the General Data Protection Regulation (GDPR). Appropriate technical and organizational measures are taken to protect personal data.
For the delivery of its services, Plants for Health engages processors who process personal data on its behalf, including the LMS provider, payment processors, and email software. Data processing agreements compliant with the GDPR have been concluded with all processors.
Participants have the right to access, correct, or request deletion of their personal data. Requests may be submitted to [email protected]. Plants for Health complies with statutory retention periods for medical and administrative records.

7. Right of Withdrawal
A consumer who has entered into a distance contract (for example, via the website) has the right to withdraw from the agreement without giving reasons within 14 calendar days of the date the agreement was concluded.
For digital services and online programs: if the participant has expressly consented to immediate delivery of the service before the withdrawal period expires, and has acknowledged that the right of withdrawal is thereby waived upon full performance of the agreement, the right of withdrawal lapses at that point. Plants for Health records this consent at the time the agreement is concluded.
Plants for Health will confirm receipt of a withdrawal request by email. Refunds will be made within 14 days of receipt of the request, using the same payment method as the original payment.
The right of withdrawal does not apply to:
- services that have already been fully performed with the participant’s prior express consent;
- personalized products or services specifically tailored to the participant.
Note: the right of withdrawal as described above is based on EU consumer law (Directive 2011/83/EU). Participants located outside the European Union may have different rights under their local legislation.
8. Liability
Participation in the Plants for Health Lifestyle Program is intended to support health. Plants for Health recommends that participants consult their treating physician before starting the program, particularly if they have pre-existing medical conditions.
Plants for Health is liable for damages that are the direct result of its own willful misconduct or gross negligence, or that of its employees. For all other damages – direct or indirect, including consequential damages – liability is limited to the amount paid by the participant for the service from which the damage arose.
This limitation of liability does not affect any statutory rights of consumers under mandatory applicable law.
9. Force Majeure
Plants for Health is not liable for damages resulting from force majeure: circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, serious failures of IT infrastructure or internet connectivity, and government measures.
In the event of prolonged force majeure (exceeding 30 days), either party has the right to terminate the agreement for the part not yet performed. Amounts already paid for services not yet rendered will be refunded on a pro-rata basis.
10. Intellectual Property
All intellectual property rights – including copyrights, trademark rights, and database rights – relating to the products, services, content, and materials of Plants for Health are held exclusively by Plants for Health.
Participants may use materials obtained solely for personal, non-commercial purposes. Reproduction, distribution, publication, or commercial use without prior written consent from Plants for Health is not permitted.
11. Use of the Website and E-Learning Platform
Use of the Plants for Health website and LMS is permitted solely for personal, non-commercial purposes.
Copying, publishing, or otherwise using content from the website or LMS without written consent from Plants for Health is not permitted. Plants for Health reserves the right to restrict or terminate access in the event of misuse or breach of these Terms and Conditions.
12. Warranty and Complaints Handling
Plants for Health warrants that its products and services meet the specifications described on the website and the quality standards that may reasonably be expected.
A complaint regarding the quality of a product or service may be submitted in writing to [email protected] within 14 calendar days of discovering the defect, with a clear description of the issue.
Plants for Health will respond substantively within 14 business days. If the complaint is upheld, Plants for Health will offer – at its discretion – rectification, replacement, or full or partial refund. Refunds will be made within 14 days of written confirmation of the decision.
13. Assignment
Rights and obligations under this agreement may not be transferred by the participant to third parties without prior written consent from Plants for Health.
Plants for Health is entitled to transfer its rights and obligations under this agreement to a third party, for example in the event of a merger, demerger, or acquisition. The participant will be informed in a timely manner and has the right to terminate the agreement if the transfer results in a material change to the services.
14. Reimbursed Care and Supplementary Terms
Plants for Health currently offers services exclusively outside the scope of statutory health insurance reimbursement. Participants are personally responsible for payment of the services they purchase.
Should Plants for Health offer reimbursed care in the future – including dietitian consultations covered by health insurers – supplementary terms may apply to those services. Such supplementary terms will be published on the website in a timely manner and will form part of the agreement. In the event of a conflict between supplementary terms and these Terms and Conditions, the supplementary terms shall prevail.
Participants wishing to claim reimbursement through their supplementary health insurance are personally responsible for verifying their policy terms and submitting claims to their insurer.
15. Amendments to the Terms and Conditions
Plants for Health reserves the right to amend these Terms and Conditions. Amendments will be communicated via the website and/or by email at least 30 days in advance.
For ongoing agreements, amended terms take effect only upon expiry of the existing agreement, unless the participant expressly consents to earlier application. In the event of material amendments, the participant has the right to terminate the agreement before the amendments take effect.
16. Complaints Procedure
Complaints regarding products, services, or the performance of the agreement may be submitted in writing to [email protected], stating the participant’s name, contact details, and a clear description of the complaint.
Plants for Health aims to respond substantively within 14 business days. If a complaint requires more time, the participant will receive an acknowledgment within that period, including an indication of the expected response time.
Plants for Health is affiliated with the Stichting Klachtenregeling Gezondheidsbevordering en Leefstijl (SKGE), a Dutch independent complaints body for health promotion and lifestyle services, and has access to an independent complaints officer through SKGE. Participants who are unable to resolve a complaint directly with Plants for Health may contact the complaints officer free of charge. If the complaint remains unresolved, the participant may refer the matter to the SKGE disputes committee. Further information is available at www.skge.nl. Please note that SKGE procedures are conducted in Dutch and are primarily intended for participants based in the Netherlands.
In addition, consumers in the European Union have the option to submit a complaint via the European ODR platform: https://ec.europa.eu/consumers/odr
17. Governing Law and Jurisdiction
This agreement is governed by Dutch law. Disputes that cannot be resolved through the complaints procedure or SKGE will be submitted exclusively to the competent court in Utrecht, the Netherlands, without prejudice to the right of a consumer to bring proceedings before the court of their place of residence.
Participants located outside the European Union acknowledge that Dutch law governs this agreement and that the courts of Utrecht have jurisdiction, subject to any mandatory provisions of their local consumer protection law.
